2. Placing order
Your purchase of any of the products offered on the Website (“Products”) is subject to these Terms and Conditions and by placing an order for any Product, you confirm that you have read these Terms and Conditions and agree to be bound by them. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that Products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of Products may be lost. In such case, you will be required to re-enter your selection of Products to the shopping bag.
3. Order confirmation
After submitting your order, we will send you an order confirmation e-mail acknowledging your order and including your order number, details of the Product or Products you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy the Product(s) ordered. All orders are subject to acceptance by us. We are not obliged to accept your order and may, at our discretion, decline to accept any order. You do, however, acknowledge that by clicking on the "Proceed to payment" button, you enter into an obligation to pay for the Product(s).
4. Acceptance and shipping confirmation
Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order and these Terms and Conditions. The contract between you and us in relation to the Product(s) ordered (“Contract”) will only be formed when we send you the shipping confirmation email. After entering into the Contract, we will be under a legal duty to supply you with goods that are in conformity with the Contract. Please note that the Contract will only relate to the Product(s) which have been confirmed in the shipping confirmation email. We will not be obliged to supply any other Product(s) which may have been part of your order until such Product(s) have been confirmed in a separate shipping confirmation email. Please note that R O C H E L L E does not guarantee that all Products presented on the Website are in stock or are available for purchase at the time of your order. If a Product is unavailable, we will contact you shortly, by phone or by e-mail.
The prices and delivery costs shown on the Website include VAT. The prices and delivery costs shown on the Website may vary from time to time and R O C H E L L E is not bound by the price until R O C H E L L E has accepted the order by sending the shipping confirmation to you. The prices may also vary between the physical store and the Website. If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by e-mail about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. R O C H E L L E always reserves the right to cancel any order prior to our acceptance of the order. If we already have received payment for a cancelled order we will refund you the amount of the purchase. The refund is made using the same payment method you used at the purchase. Please also note that R O C H E L L E may cancel the order even if it has been accepted by R O C H E L L E under the condition that you realise or should have realised that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.
6. Personalised items
Personalised products through printing of initials cannot be returned or refunded. Once the order has been sent by the customer and confirmed by R O C H E L L E , the customer will be informed via an order confirmation email. Once the order is processed and accepted, the customer will receive a shipping confirmation email. Personalised items may be delivered in a time slot indicated on the site which may be longer than regular delivery slots. Because of the clearly personalised nature of personalised products and the fact that they are produced specifically for the customer, they cannot be returned, refunded or exchanged. Similar, the customer does not have the right to cancel the order.

When selecting the PayPal option, you will be directed to the PayPal site to “Log In” and review the amount shown before clicking “Pay Now”. Once this transaction is complete, you will then return to the Website.
Your order will be fulfilled by the delivery date set out in the shipping confirmation email or, if no delivery date is specified, then within 30 days after the date of the Order Confirmation, unless there are exceptional circumstances. The delivery costs are shown in connection with the shipping methods at the checkout stage. Your order will be delivered by UPS to the shipping address you have indicated. Products comprised within the same order cannot be delivered to different addresses. All orders are fully traceable with a tracking number that will provide updated information about your shipment.

At the moment we offer one shipping method with DAO. Your order will be delivered to a pickup point or the delivery address you specify when placing your order. If you opt for this collection service, your entire order will be delivered to your chosen collection point and will be available for collection by you from the date specified in the Order Confirmation. When collecting your order, you should take with you the Order Confirmation, along with some form of identification (such as a credit card or driving licence).
If your delivery address is geographically remote, for example certain outlying islands or other isolated locations, it is possible that we may not be able to deliver there. If that is the case, we will notify you before we accept your order. We reserve the right not to deliver to any country that is prohibited by applicable export laws.
Orders cannot be delivered to PO Box or similar addresses. Please also note that you must comply with all applicable laws and regulations of the country for which the Product(s) are destined. We will not be liable for any breach by you of any such laws. — First-time order policy
9. Risk and ownership
The Product(s) ordered will be at your risk from the time of delivery [or collection (as the case maybe).] Ownership of the Product(s) ordered will also pass to you on delivery [or collection (as the case maybe), provided full payment of all sums due in respect of the Product(s), including any delivery charges, has been received.
10. Cancellation rights
Except in relation to certain Products, you are entitled to return the Product(s) you have purchased at any time before your order is delivered and up to 14 days afterwards, beginning on the day after your order (in its entirety) is delivered to you or, if you opt (where available) to collect it from one of the collection points offered by our courier and that collection point is managed by a third party other than the courier (for example, a local convenience store), the day after it is delivered to that third party. In order to exercise your cancellation rights, you must inform us email@example.com by means of an unambiguous notification (e.g. through letter sent by post, fax or e-mail) of your decision to return the Product(s), including your name, address and order reference.
In order to receive a refund for the Product(s) you must return the Products and/or send the notification that you wish to return the Products within the 14 day period referred to above.
You will not have any right to cancel a Contract for the supply of the following Product(s):
• Perishable items;
• Audio and/or visual; recordings or computer software or hygiene-sealed items, in each case, where the sealed packaging has been opened; or
• Product(s) that have been personalised such having your initials on your Product(s) or having Product(s) made to your own bespoke specifications (if we offer such options);
unless such Product(s) were damaged or faulty when delivered to you or have been incorrectly delivered.
You must return the Product(s) to us within 14 days after the day of notifying us that you wish to return the Product(s). The returned Product(s) must be in the same condition in which you receive them (which does not interfere with your right to take any reasonable steps to examine the Product(s) and make sure they conform to your order). You have a legal obligation to take reasonable care of the Product(s) while in your possession. If you fail to comply with this obligation, we may have a right to deduct the cost of any deterioration (due, for example, to your having used the Product(s)), up to the price of the Product(s), from the refund to which you are otherwise entitled. We will refund all payments that we have received from you including the costs of delivery (except any additional costs that result from you having chosen a different method of delivery than the cheaper method offered by us). For such repayment, we will use the same means of payment that you have used for the initial transaction unless expressly agreed with you otherwise; in no case will we charge you any fees due to such repayment.
Purchased products are exchangeable into a different size and color in accordance with the terms set forth in this section 9. All exchanges are based on stock availability. If you have exchanged a product, R O C H E L L E will pay the shipping costs for the new product. Please note that sale products are non-exchangeable but can be returned for a full refund.

You can easily and conveniently handle the reconsignment of your purchased products as follows:
• Place the item(s) and with order number and customer name in the original shipping box, or any other solid carton box.
• Close the box and tape it securely.
• Choose your retur carrier and pre-pay your shipping. We recommend DAO.
11. Defective products
If you receive defective products, please notify us immediately. According to the Civil Act you are entitled to complain about defective products within one year. However, you must always notify R O C H E L L E within a reasonable time after you have detected that the products are defective. If R O C H E L L E consider the products to be defective, R O C H E L L E will make a full refund including shipping costs.
